forgive my ignorance, and I do realize this is probably a mute point, but it seems like if the Japs are ahead on points the kami rule should be nullified, my oponent went wild in China, so even though I am pushing hard in 43 into sra and getting points, he still has a good lead. It would be nice to restrict the use of this feature bases on points.. just a thought

Nah.

Kamikazes are to the Japanese what Essex carriers, corsairs, etc. are to the Allies-a weapon tool in the toolbox. Unless there is a rule to restrict some Allied tools of warfare when they start pulling ahead in points, I don't see a rationale for restricting Japanese tools of warfare when they're ahead on points.
