If both sides find each other and one side has air and the other doesn't. Does the side with the air get to choose surface without using surprise points?

It can become surface combat without spending surprise points.

1) Deny spending surprise points to pick combat type.
2) The side with the air deny to make it a air combat.
3) Then if one side have a SUB included and the opponent has any convoy points included then the side with the SUB deny to make it a submarine combat.
4) Then it becomes a surface combat.

In short. If you have air and no CP (or other side has no SUB) and other side has has no air then you can pick surface combat without spending surprise points.
