Looking at terrestrial history, there have been many invasions and incursions and border shoving matches short of "war," as well as proxy wars, subversion etc. Not to mention in any detail economic intrusions - yes, mining or other exploitation. A mining ship active in alien territory should be able to mine if ordered, but the local space gendarmes may come round and chase them off - or blast them to bits - and away we go. Border activities are a good way to wind up with someone having casus belli if not directly escalating to war. Having your people within alien territory, subjugated or not, seems like casus belli for both sides if colonization is attempted or opposed. There are so many rich options between declaring war and doing nothing! I hope some of that gets reflected in Legends.
