Lets say that we have two units which have spotted each other at the same time and opened fire at the same minute (of firing phase).

Unit 1 goes first and Unit 2 takes casualties.
Unit 2 returns fire but at this point it is already partially depleted and thus produces less firepower in this firing phase.
Unit 1 got an advantage simply because the game engine allows it to shoot first.

I would like to say that the better course of action would be to allow Unit 2 shoot at full ability during this firing phase(even after it has been hit) and only reduce its firepower on the next firing phase.

The units which have spotted each other at the same time should have equal chances.

The way you want is what the game does now. There are two types of combat exchanges. A surprise or single side fire (AD shots) or "duels" where fire is exchanged in a simultaneous fashion. Even though losses are shown against the first hit unit, its shot is at the strength it started with in the duel.
