I have the suspicion that by this stage in his ruling the judge had ceased to treat the case very seriously?

Scots Law is a bit different to both the English common law and some other European models. In particular its common for judges to provide guidance about his/her thinking to both prosecution and defence during a trial. In this case he warned the group bringing the case to make sure they stuck to a line of argument he was prepared to take seriously - and they didn't (a number of times). Given this advice, his judgement was quite deliberately an attempt to set out exactly why he was ignoring the arguments they did make.
