I guess it comes down to just not that alike? The most famous case like this, or the one I most remember was the John Fogerty one where he got up on the stand and he basically said, "This is how I write. I can't be asked to write differently than I know how." and he won.

Although I will say "Old Man Down the Road" sounds a lot like "Run Through the Jungle".

His case was that he stole from one of his own songs from years before that he didn't own the rights to. Kinda crazy, if you ask me.

This lawsuit is BS and should be thrown out. Where were the plaintiffs 45 years ago? "Randy California"?...give me a break!

In the A Whiter Shade of Pale lawsuit the plaintiff won 42 years after the song was released.

The thing about it is, I hear songs all the time that sound very similar to each other. Especially at the beginning. There are only so many ways songs can be played and eventually someone will write similar.

That is true, that's why, in some cases, that it is hard to prove plagiarism...it's kind of a crap shoot.

Entirely different melody line. The only thing the two songs have in common is a descending bottom line. Where are the rest of the notes that make up that first chord, A minor? You cant copywrite 4 notes. Hell you cant even copywrite a chord progression. If you could Chuck Berry would have had the Beach boys in court every week
