Fortifications in 1.08

It used to be the case that the speed with which fortifications are build was proportional to the movement points of the unit. This has changed in 1.08. Movement points now don't matter any more. The only thing that matters is the construction value of the unit. You can easily check this by railing Russian units to the land bridge on T1 and derailing them. The stacks with construction values of 50 or more will build fortifications to 1 (10%) on T2. By T3 fortifications are at 2 (10%). But you can also move units on land until they have 0 MP and they still build fortifications according to their construction value.

Is this by design or is it a bug?

In friendly territory only half of construction points is lost when all MP are spent (for non-AI players). The question is whether in a server game you are considered AI player during the game, as happened with initialization. Also it's worth noting that usually it's the cap per turn/per hex/per unit that limits fort building most serverly at the low levels, not construction points. At fort level 0 construction points are multiplied by 3, so only 17 are required to build level 1 (and 34 after spending all movement), even without taking into account help from HQ sappers.

With 1.07.15 I get fortifications to only 0 (28%) with similar setup. Quite a difference.

It may be easier to get the first two levels, but it will be harder to get higher levels (mostly due to max limit).
