It happens and has happened before. Everyone here knows of the USS Caine (novel) The problem always starts at the top and the captain is always responsible. Short and simple. My step brother was stationed on a Navy Oiler in the early seventies. Disenchantment with the war and the oppressive heat of Subic Bay did not sit well with the crew in general. Pretty unhappy ship and a number of sailors deserted-including him. They finally caught up with him in San Francisco where he was arrested, tried and given a general discharge. He was lucky in that the war was winding down and the military just did not want to bother with him.

The Captain is always responsible but:

The Captain of the USCGC Blackthorn (LCDR Sepel) was promoted to CDR following an official admonishment resulting from the collision of his ship with the M/V Capricorn in Tampa Bay in which 23 of his crew died.

The facts surrounding the blame laid upon him were officially omitted by order of the Commandant of the USCG from the records reviewed by his subsequent promotion board.

The legal standard of proof beyond reasonable doubt can affect things in illogical ways.
